摘要
《基本医疗卫生法》已列入第十二届全国人大五年立法规划。围绕该法的制定,理论界和实务界展开了分析和探讨,该法的性质、对象、原则、范围、体系等渐渐明晰。本文从《基本医疗卫生法》立法模式的角度,归纳出全面-集中、中心-扩散、授权-分权三种立法模式,并根据上述立法模式的特点,提出了《基本医疗卫生法》应当采用何种立法模式的建议。
Basic Medical and Health Law has been included in the five years legislation program of the 12 th session of the National People＇s Congress. Around the making of this law, after the analysis and discussion in the theoretic and practical field, its nature, object, principle, scope and system gradually became clear. This article,from the perspective of the legislation mode of Basic Medical and Health Law, summed up three legislative modes：comprehensive- concentrated mode, center- diffusion mode, and authorization- separation mode, and put forward the legislative mode for Basic Medical and Health Law based on the characteristics of the legislative modes.
