摘要
正当性是现代版权制度的基石和现代版权理论研究的逻辑起点。版权诞生以降,其法定及适用的正当性即屡被诘疑。微信作为一种网络表达普及之后,它的版权问题也随之受到关注,特别是其版权的正当性尤受质疑,此类质疑所涉范围之广、所触理论之深,均对现有版权理念形成了较大的冲击。论证表明,与以往历次版权危机化解的路径相似,有关微信空间版权正当性的质疑都可以通过对既有理论和制度的调适予以回应和化解。反思微信空间版权正当性,不是为了推翻,而是为了使人类社会这一数百年来渐趋成熟的法制文明成果——版权制度,更加优化,更加深入人心。
Legitimacy is not only the basis of copyright, but also the cornerstone of the modern copyright system. It is also the logical starting point of the study of modern copyright theory. Since copyright was born, its legitimacy has always been criticized. In WeChat, copyright legitimacy is questioned once again. Because of difference originated from the WeChat and other forms of media, the breadth and depth of the question has a greater impact on the existing copyright. The demonstration shows that the path is similar to the previous copyright crisis, and the rise of the question can be answered by the adjustment of both theory and system. Reflection on the copyright in the WeChat is not to overthrow the legitimacy of copyright, but to optimize the copyright system, which is grown with the civilization of human society, to get deeper into mind.
