摘要
新《食品安全法》中的"行为规制"属于"权力性规制",具体分为行政许可规制和日常监管规制两类。行政许可规制有"应当取得许可"、"无需取得许可"、"没有明确规定"三种情形;日常监管规制分为风险管理和过程监管。通过原理分析和实效分析,可以定位新法的不足,为行政执法提供补充。
Regulation of behavior in the new Food Safety Law is authoritative regulation, which can be divided into regulation oflicensing and day-to-day supervision. Regulation oflicensing consists of "must be licensed", "need not to be licensed", "no explicit stipulation". Day-to-day supervision includes risk management and process supervision.Based upon analysisof principle and actual effect, defects in the new law can be positioned for the improvement of ?law enforcement.
