摘要
专利侵权不停止侵害的替代措施"合理费用"和正常的专利许可费、专利行政强制许可费、当然许可中的许可费及损害赔偿中的合理许可费不同;在程序上合理费用的确定需在当事人协商达不成协议的情况下,法院才能依职权裁决;合理费用不应一次性给付;合理费用应根据个案考虑相关因素。
The reasonable cost,as one of the alternative measures for the aftermath of patent non-stop infringement,is different from the regular patent royalty,the patent administrative compulsory license fee,the royalty of license of right,and the reasonable royalty in damages.The sum of the reasonable cost should be negotiated by both parties.Only when both parties fail to reach an agreement,can the court award,ex officio,the reasonable cost.The reasonable cost should not be one-time payment.The determination of the reasonable cost should take into consideration of relevant factors based on individual case.
