摘要
近年来,专利蟑螂的负面效应骤显,许多国家和地区纷纷出台措施对其进行规制。在美国,联邦政府制定了五项行政措施和七项立法建议,国会讨论了多项立法议案。在欧盟,法院避免给予专利蟑螂过高的专利损害赔偿,并采用律师费用转移制度。在韩国和我国台湾地区,设立专门的基金应对专利蟑螂现象。研究分析这些措施,对我国预防和应对专利蟑螂现象具有重要的借鉴意义。
In recent years, the increasingly evident negative effects of patent trolls prompt many countries and regions to regulateon them. U.S. federal government formulates five administrative measures and seven legislative proposals, while the Congressdiscusses a number of legislative proposals. To avoid exaggerated damage compensation caused by patent trolls, EU Courts let thelosing party bear the lawyer, s fee. Special funds have been set up to deal with patent trolls in South Korea and Chinese Taiwan.Researches on such countermeasures are significantly beneficial to China to caution against and deal with patent trolls.
