摘要
假想防卫过当是一个复合性概念,是假想防卫与防卫过当的竞合。假想防卫过当既有假想防卫的一面,又有防卫过当的一面。现有理论在面对假想防卫过当问题时难以兼顾假想防卫过当具有的两重性。假想防卫过当存在故意、过失和意外三种形态,假想防卫过当的罪过形态以防卫过当的责任形态为准。
Imaginary over-defense is the concurrence of imaginary defense and over-defense, and it has the characteristics of both imaginary defense and over-defense. The existing theories cannot give consideration to them both. There are intentional, negligent and accident imaginary over-defense. The sin of an imaginary over-defense must be depended on the sin of the over-defense.
