劳动合同法实施后不同职工群体劳动权益保障差异变迁研究 被引量:18

Research on the Disparity of Labor Rights Security among Different Worker Groups before and after the Labor Contract Law

摘要 本研究基于2007年与2012年中国职工状况调查,采用比率差异检验法分析了《劳动合同法》实施前后,不同文化程度、户籍身份与就业身份的职工群体在各项劳动权益保障上的差异变化。结果显示劳动合同法的制度力量推动了不同劳动者群体在某些劳动权益保障方面的差异日益缩小,但在多数劳动权益状况上,差异现象依然显著。 Drawing on national survey data of more than 80000 workers conducted by All-China Federation of Trade Union (ACFTU) in 2007 and 2012 respectively, this article uses proportion difference test to investigate the differences in labor rights security among worker groups with different educational levels, household registration and employment status. The results shows the trend of convergence and divergence. The convergence is seen in that the gap between different employee groups in some aspects of labor rights narrowed. The divergence is seen in that the protection of most labor rights of employee groups with low educational level, migrant workers or ordinary employment status are still in significantly relative disadvantage.
