摘要
法治政府评价旨在推进法治政府建设,体现评价的工具理性。本文将政府绩效评价的理念方法导入法治政府建设评价中,衍生出法治政府绩效评价这一新的概念范畴。法治政府绩效评价强化评价的价值理性,体现结果导向与满意度导向,追求法治的公信力,或者说有公信力的执行力。为实现2020年基本建成法治政府的目标,体制内部自上而下的评价应定位为绩效导向的目标考评,同时引入社会评议,推进评价实施权的外部化;在体制外部,应培育独立第三方评价主体。服务于评价的目标及功能定位,指标体系被视为评价的核心问题,决定评价的科学性。作为层次分析法特例,利用专家咨询调查,构建集客观指标评价、专家评议、公众满意度测量于一体,包括制度建设、过程保障、目标实现、法治成本和结果满意等5项一级指标、14项二级指标及41项三级指标的法治政府绩效评价指标体系,具有广泛的适应性和可检验的科学依据。
The Evaluation of government ruled by law aims at promoting the construction of the government ruled by law,which reflects instrumental rationality of the evaluation. The article imports one concept of government performance evaluation from the government ruled by law,that is performance evaluation of government ruled by law. The performance evaluation of government ruled by law strengthens the value rationality of the evaluation,embodies its result orientation and public satisfaction orientation and pursues the credibility of the rule of law or the execution of credibility. In order to achieve the target of 2020,the top-down evaluation inside the system should be positioned as the performance-oriented objective assessment,meanwhile,introduce the social evaluation and promote the implement right of evaluation to externalization; On the outside of the system,it should cultivate the independent third party evaluation subject. At the service of the evaluation target and functional localization,the index system is regarded as the core of the evaluation and decides the scientificity of the evaluation. As the particular case of the analytic hierarchy process,using expert consultation investigation,we build an objective index evaluation,expert evaluation,public satisfaction measurement in one of the index system of performance evaluation of government ruled by law. It includes 5 first-level indicators,14 second-level indicators and 41 third-level indicators,and covers institutional construction,process assurance,target implementation,cost of the rule of law and outcome satisfaction.
