摘要
[目的/意义]高校图书馆为规避产权纠纷、降低侵权风险,致使自建特色数据库陷入开放度低、共享度差、违背建库初衷的尴尬处境,为此研究自建库如何规避侵权风险具有现实意义。[方法/过程]采用案例分析法和实证研究法,以实践中出现的问题作为案例,分析和探讨特色库建设的侵权风险规避对策。[结果/结论]指出高校图书馆可以采取分级管理资源及用户、地域限制、签协议或合同、版权声明、订购附加条款等解决策略。
[Purpose/significance] In order to avoid property dispute and lower infringement risk, university library’s self-built characteristic database often fall into the awkward situation of low degree of openness, low degree of share and defeating original purpose of database construction, so researching how to avoid infringement risk for self-built characteristic database is of practical significance. [Method/process] The paper uses case analysis method and empirical research method, takes problems in practice as case, to analyze and discusses strategies of avoiding infringement risk of characteristic database. [Result/conclusion] The paper points out that university library can adopt the solution including hierarchical management of resources and users, geographical restriction,signing of agreement or contract, copyright statement, additional ordering clauses and so on.
