摘要 公民学习权,简单说就是公民自主性地获取知识以满足生存和发展的权利。学习权学说把学习的自主选择确立为基本立场,强调国家有义务为此提供相应的保障条件。这是公民享有自由发展的平等机会的标志。学习权最大化的实现依赖终身教育体系的发展和壮大,依托学习型社会的构建。公民学习权是终身教育理论脉络的逻辑起点,对学习权实现的关注透射出对传统教育理论的反思和对学习型社会构建的国际潮流的顺应。学习权的属性兼具内生的自由权品性与外化的社会权特质,孤立空泛的强调学习权的自由属性而忽视其实现的社会依托性必然陷入无源之水的尴尬境地。学习权的实际运化中与传统意义的"受教育权"存有混同与分立的动态化平衡之势。学习权的实现路向应从主体意识的自省入手,在外化的权利诉求冲突中逐步迈向理性的回归并得以型塑,达到与制度的契合。随着公民主体意识的强化,以最为公平的方式给予最大多数群体学习权诉求实现的最大化,这是教育政策制定与实施的应然选择。 Citizens' right of learning, simply speaking, is the right for citizens to gain knowledge by themselvesto meet the requirement of survival and development. The theory of learning right, taking the independent choices oflearning as the basic stance, emphasizes the county's obligation to provide the appropriate security conditions. Thisis a sign for the citizens to enjoy equal opportunities of free development. The maximum realization of the learningright relies on the development of lifelong education system, and the construction of a learning society. Citizens' learning right is a logical starting point for lifelong educational theory, and the attention paid to the realization of thelearning right reflects the rethink of the traditional education theory and the conformity to the international trend ofbuilding a learning society. And its property contains endogenous freedom and external trait of social rights.Therefore, to lay stress on its free property in an isolated and vague way while ignoring its dependence on the societywill inevitably fall into a passive embarrassment. In the implementation, there is a discrete dynamic balance ofconfuse and separation between the learning right and the traditional sense of "the right to receive education". Therealization of learning right should start with the consciousness introspection and gradually moves towards rationalreturn in the conflicts of outside rights claims and to be shaped, in order to agree with the system. With thestrengthening of civil consciousness, to give the majority the right to appeal maximum learning in the most equitableway is the ought-to-be choice for the formulation and implementation of education policy.
