摘要
侦查员是侦查行为的主体,司法授权和刑侦改革,应以激发侦查员的主观能动性为检验标准。案侦活动中的领导指挥与每个侦查员的执法取证,都是群体主体的行为。其管理组织涉及侦查效益,这有领导者的职责问题,每个人都须为其侦查行为负责,主办侦查员是领导和搭档间的纽带。制度构建与侦查主体的关系,应该适应侦查队伍的培养、发展和完善。
Investigator is the main body of investigation activities. In Judicial authority and criminal investigation reform, we should make it as a standard that whether we can motivate investigator＇s subjective initiative. Both leader＇s commanding and every investigator＇s obtaining evidence during investigation are activities of group subject. Because its management organization is connected with investigation effectiveness and is the leader＇s duty. Everyone should be responsible for his investigation activity. Besides,the sponsor investigator is the bond between the leader and his partner. The relationship between system construction and investigation body should adapt to the training, development and improvement of investigation teams.
