摘要
随着时代不断发展,近年国内学界开始逐渐关注到私人刑事调查这一昔日鲜有涉足的问题。通过对近年国内学界在私人刑事调查产生根源、历史发展、性质、优劣、取证效力和完善六大方面的研究进行归纳综述,认为现有研究既取得了一定成绩,但同时也在研究范式、分析方法和对本土语境的关注上暴露出了一些不足。
With the development of times,more and more scholars in recent years are paying attention to the study of domestic private criminals that was neglected in the past.This paper first makes a review on the study of domestic criminals from the perspectives of the origins,the historical development,the nature,the advantages and the disadvantages,the effect of obtaining evidence,and the improvement.Then the paper holds that some achievements have been made in the area,but there are still some shortcomings in the study paradigm,the analyzing methods and the concern on domestic context.
