摘要
刑事政策学已经通过立法、司法解释等多种方式渗透到刑法教义学领域,通过刑事政策学的辅助,刑法教义学能够为大量例外性案例提供统一的解答标准。不仅如此,运用刑事政策学也能为争议性案件提供定性与量刑的标准。
The criminal policy science has infiltrated the doctrine of criminal law by legislation and judicial interpretation. With the help of criminal policy science,the doctrine of criminal law can provide unified standards for lots of special cases. What＇s more,criminal policy science provides standards of criminalization and sentencing for controversial cases.
