摘要
克里米亚公投入俄引起了国际社会对其合法性的争议。欧美国家和俄罗斯争议双方围绕民族自决权等国际法基本原则展开对垒,都欲将其作为自身立场正当性的护盾,令作为独立公投法理基础的民族自决权理论也随之受到质疑。克里米亚公投事件折射出当前民族自决权理论的模糊性和发展局限性,亟需重新审视其价值,明晰其发展方向,拓展其发展空间,以最大限度抑制其负面作用,发挥其当代价值。
Referendum in Crimea joining Russian triggered international controversy about its legitimacy. Both western countries and Russia pitted against each other from the angel of the right of national self-determination which is the basic principle of international law. The controversy makes the theory of the referendum on independ-ence on the legal basis of the right of self-determination theory subsequently questioned. Crimeaˊs referendum re-flects the ambiguity and the limitation of the theory of the right of national self-determination. It is urgent to re-examine its value,clarify its development direction and expand its development space so as to restrain its negative effect and exert its contemporary value.
