摘要
对于法定成年年龄的界定,目前学者的理论研究与民法典草案建议稿的官方意见并不一致,且学界对相关问题也未引起足够关注,故有必要对之进行研究。从认知心理学的理论和民事行为能力制度与成年年龄的相互关系、国外立法例和国际条约的规定以及我国成年年龄制度的法律和社会效果评价出发进行分析,保留《民法通则》第11条"十八周岁以上的公民是成年人"之规定具有妥当性,但应当考虑在此基础上增加成年延长至高中毕业的补充规定。
The existing theoretical researches made by scholars are inconsistent with the official advices of the Civil Code draft in defining the legal adult age, and haven't aroused enough attentions to the relative questions. So it is necessary to make a deep research. According to the mutual relationship among the cognitive psychology, capacities for civil conduct and legal adult age, this paper analyzed the foreign legislation, international regulation, Chinese adult age laws and social effective evolution, and claimed that it is rational to reserve the article 11 th 'A citizen aged 18 or over can be an adult' in General Principle of Civil Law. But, we must take into consideration to make s supplementary provision for the adult extending to the high school.
