摘要
人道主义和功利主义价值观、动机和合法性制度之间的冲突是引起广西玉林"狗肉节"食狗和护狗行为冲突的内在原因。在现有道德和法律前提下,食狗行为不善也不恶。要化解这场冲突,政府应通过开展社会大讨论促进大众形成共识,并利用道德引导、完善法规等手段逐步实现移风易俗,提高整个社会的道德水准。
Based on the issue of Guangxi Yulin ＂ Dog-Meat- Festival ＂,this article created the conflict behavior model from its the internal mechanism. This paper not only pointed out the conflict among the value of humanitarianism and utilitarianism,motives and legitimate mechanism are the essential reasons of eat and protect dog but also contributed the standard of moral evaluation for these behavior. Finally,the author thinks the government should organize the discussion to get common cognition of the publics and gradually shift customs through moral guidance,perfect law and regulations to improve the moral level of the whole society.
