摘要
在我国高校权力中,剩余控制权与剩余索取权配置结构出现了不对应问题,高校行政权力掌握着高校的剩余控制权而不用承担剩余索取权中的风险,学术权力无力争夺剩余控制权且不享有剩余索取权中的收益。为此,高校应该提高学术人员在剩余控制权中的地位,增加行政人员的剩余索取权,实现剩余控制权和剩余索取权配置结构的相对应。
There is an asymmetric problem between residual control and residual claim in the university power. Administrative power holds the r^sidual control and do not bear the risk of the residual claim; academic power is unable to compete for the residual control and does not enjoy the benefits of the residual claim. University should improve academic staffs" position in the residual of control, strengthen administrative staffs" residual claims, at the same time, and achieve reunification of the residual control and the residual claim.
