摘要
研究目的:分析和探讨中国统一城乡建设用地市场的法律路径。研究方法:法律文本分析法。研究结果:公权力、私权利,以及相互之间的冲突,导致中国统一城乡建设用地市场实践中出现诸多问题。研究结论:建立城乡统一建设用地市场,需要理顺公权力与公权力之间的关系,确认和保护集体建设用地的权利;理顺私权利与私权利之间的关系,实现统一市场中主体平等;理顺公权利与私权利之间的关系,促进统一市场中城乡建设用地的竞争。
The purpose of this paper is to analyzea legitimated pathway for establishing an integrated land market between urban and rural sectors. Method employed is legal analysis. The results indicate that the conflict between public power and private rightlead to the practical problems to establish the integrated land market between urban and rural sectors. It is concluded that to establish the integrated land market should pay attention to distinguish the relationship between private rights on the urban and rural land, the relationship between public and private interests, and the relationship among different powers in the eminent domain.
