摘要
我国集体经营性建设用地使用权流转的统一性立法尚付之阙如。公权力和私权利配置失衡是我国目前集体经营性建设用地制度缺陷的集中体现。亟需在详细梳理集体建设用地使用权流转中的公私权配置现状基础上,科学厘清公私权配置失衡的现实问题及原因,为优化集体建设用地使用权流转中的公私权配置夯实现实与理论基础。
The unified legislation on the transfer of the right to use collectively constructed construction land in China has not yet been introduced.The concentrated manifestation of the current system of collective management land use in China is the imbalance of public power and private rights.Need to detailed review of the status quo of public power and private rights in the transfer of collective construction land use rights.Then scientifically clarify the practical problems and causes of the imbalance of public power and private rights.And then realize the real and theoretical basis in optimizing the allocation of public power and private rights in the transfer of collective construction land use rights.
