摘要
美国教育惩罚对违规行为实行的是"零容忍"制。政府为学校制定了体罚的实体合法性标准和程序合法性标准。教育惩戒遵循的是"有法可依、违纪必究"原则。中国高职教育应借鉴美国教育惩戒机制,明确教育惩戒的合法地位。高职院校在法律规范基础上,建立具体、明确和量化的校规,公开、公正、合法行使教育惩戒权。
American education punishment for violations is a system of “zero tolerance” .T he government also made the legitimacy standard for the entity of disciplinary and procedure of the school ,and the education disciplinary of American follows the rules of “rules must be binding ,violations must be punished” .American education disci-plinary mechanism and forms as well as its specification is worthy of reference for higher vocational colleges in China , in order to clarify the legal status of education and punishment better .Taking the student-oriented policy ,Higher vocational colleges in China should follow the principles of administration according to the law and establish more specific ,clear and quantitative rules ,to exercise education punishment power openly ,fairly and legitimately .
