摘要
中小学教育惩戒的精细化存在细则化和判例化两条可能路径,细则化以类似于司法解释或行政规章的形式规定惩戒实施办法,判例化是将在先的惩戒案例作为后续争议的裁判依据。教育惩戒应根据具体学生情况特殊为之,中小学生身心状态差异大,教育惩戒理念和手段在不同时间和地域存在差异,判例化路径有利于应对中小学教育惩戒的差异性。同时,教育惩戒具有自治性,判例化路径更有利于尊重学校和教师的裁量权,与校规校纪实现协同。为此,需进一步完善教育惩戒纠纷解决机制,并以判例化推进实现中小学教育惩戒的精细化。
There are two refined paths of educational discipline in primary and secondary schools,namely implementation rules and case law.The form of implementation rules resembles that of judicial interpretations or administrative regulations,while case law refers to taking disciplinary precedents as the ruling basis of following grievances.Educational discipline is supposed to be employed individually.There is wide disparity in the physical and psychological states among primary and secondary school students.The ideas and methods vary in periods and areas.Thus,the path of case law is advantageous to the resolution of the diversity of educational discipline in primary and secondary schools.Furthermore,since educational discipline has autonomy,the path of case law is more conducive to respecting the discretion of schools and teachers and cooperating with school rules.Hence,it is supposed to further improve the dispute resolution mechanism of educational discipline,and advance the refinement of educational discipline by case law.
