教育惩戒与行政处罚的关系辨正——围绕《中小学教师实施教育惩戒规则(征求意见稿)》的思考 被引量:6

摘要 《中小学教师实施教育惩戒规则(征求意见稿)》发布后,教育惩戒权是否属于国家教育行政权、教育惩戒行为是否属于行政处罚引发讨论。教育惩戒开始出现在地方立法中,现实中的表现更是灵活多样。在我国法律体系中,教育惩戒不同于管教、处分和体罚。教育惩戒权不是国家权力,更不因《中小学教师实施教育惩戒规则》的制定而成为国家权力,而是专业权力,是学校和教师教育教学自由的范畴,教育惩戒行为应限于事实行为。揆诸各国,并无统一的教育惩戒模式。将教育惩戒与行政处罚区分开来,是最小代价的立法选择。 After the Rules on the Implementation of Education Discipline by Primary and Secondary School Teachers(Draft for Comments)was issued,it has been triggered discussion about whether the education disciplinary power belongs to state administrative power of education and whether education discipline belongs to administrative punishment.Education discipline began to appear in the local legislation,and is flexible and various in real life.In Chinese legal system,education discipline is fundamentally different from correction,sanction and corporal punishment.The Education disciplinary power is not state power and not to become state power because of the establishment of rules,but professional power,and the category of education and teaching freedom of school and teacher.Education discipline should be related to factual behavior.Throughout the world,there is no unified education discipline model.Distinguishing education discipline from administrative punishment is the least cost legislative option.
