摘要
目前,食药安全行政执法与刑事司法衔接严重不畅,十分有必要依法、妥善、高效处理好公安机关提前介入、案件移送、证据转化、涉案物品检验鉴定、涉物品处置及犯罪嫌疑人主观明知的判定等重要节点问题,以有效整合行政执法与刑事司法资源,推动行政执法与刑事司法的无缝衔接。
Currently, the connection between administrative law enforcement and criminal justice of food and medicine safety is seriously impeded; therefore, the following important problems should be dealt with in a legal, proper and efficient way, such as early intervention of public security organs, transfer of cases, transformation of evidence, inspection and appraisal of articles involved in cases, disposal of articles involved and identification of suspects＇ subjective awareness. In this way, resources of administrative law enforcement and criminal justice can be efficiently integrated and seamless connection between administrative law enforcement and criminal justice can be promoted.
