摘要
农村集体成员派生诉讼对于农民集体财产权益的保护具有重要意义。集体成员提起派生诉讼,以集体经济组织或者村民委员会的负责人怠于行使其对集体财产的忠实义务和善管义务为条件。派生诉讼的原告须具有本集体成员资格,并与诉请事项具有利害关系。派生诉讼中的被告为集体经济组织或村民委员会的负责人,农村基层党组织的负责人也可列入被告范围。原告胜诉的,可要求集体对其支付的必要费用予以补偿;原告败诉的,应对被告的损失承担赔偿责任,但以原告恶意诉讼为限。
The derivative litigation of rural collective member is important to collective property right. The condition is the collective economic organizations or villagers＇ committee head＇s delay in exercising the duty of loyalty and care. The plain- tiff shall have the collective membership,and an interest relationship with the matters. The defendant is the head of the collec- tive economic organizations and villagers＇ committee, or the organization of Party of rural basic level. The won plaintiff may re- quire the collective compensation for the necessary fees. The lost plaintiff shall bear the compensation liability to the defendant, but limited to the malicious litigation.
