摘要
农民集体成员撤销权在权利性质上应属形成诉权,它是《物权法》中不可忽略的制度创新。农村集体成员欲行使该撤销权需要满足其实体要件。法院在裁判农民集体成员撤销权行使案件过程中要注意撤销权行使、司法权干预与集体成员自治三者之间的关系,不可滥用司法权力而损及集体成员自治。在适用农民集体成员撤销权制度过程中还需对案由选择、当事人确定、诉讼形式选择、证据规则、提起期限等具体问题予以关注。
Farmer＇ s collective member＇ s revocation right is a system innovation that can not be ignored, it belongs to formation of litigious right. Exercising of farmers collective member＇ s revocation right should meet its necessary element. In the course of hearing farmers collective member＇ s revocation right cases, should pay attention to the relation between exercising of farmers col- lective member＇s revocation right, judicial powers, and member＇s autonomy. We should also pay attention to the following as- pects ： the selection of cause of action, parties of the action, the choice of forms of action, rules of evidence, limitation of action etc.
