摘要
首先阐明了协同创新与知识产权(法)的密切关系,对协同创新团体的各主体在知识产权(专利权)归属和相关利益分配方面存在的问题进行分析,依据《专利法》等法律法规给出了解决相应知识产权(专利权)问题的参考对策;运用多任务委托代理模型研究了企业与大学之间进行协同创新时,如何设计最优分配率的区间或者通过建立模型,激励知识拥有方进行创新研究和知识的共享。通过分析最优分配率的特点,对知识拥有方采取合理有效的激励措施,来激励其研究开发和知识共享以及规避协同创新中存在的道德风险。
This paper first explains the cooperative innovation and intellectual property rights [Law} the close re- lationship,and subjects to the collaborative innovation group in intellectual property (patent) the existence of attri- bution and related interest distribution problems are analyzed, finally, on the basis of "patent law" and other laws and r The Beijing municipal people's procurator ate are given to solve the corresponding intellectual property (pa- tents) reference countermeasure the problem; and the use of multi task principal--agent model between the enter- prise and the University of collaborative innovation,how to design the optimal allocation rate interval or through the establishment of model, to motivate knowledge owners to conduct the innovation research and knowledge sharing. And through the analysis of the characteristics of the optimal allocation rate,on the knowledge owners take reasona- ble and effective incentive measures, to encourage the research and development and knowledge sharing and avoid moral risks existing in cooperative innovation.
