摘要
指出第三方物流服务合同涉及多个主体,合同各方当事人之间也形成了多样的法律关系,包括代理关系、运输合同关系、承揽合同关系、仓储合同关系、居间关系、行纪关系等,同时第三方物流服务活动也受到不同层次法律法规的规范,专业调整第三方物流服务合同法律法规的缺失,使得相应活动的调整只能向零散分布在各法律法规中的条文寻求帮助,因此,尽早完善第三方物流服务的相关法律法规十分必要。
In this paper, we pointed out the major legal relations concerned in third party logistics contracts and the fact that specialized laws and regulations for the rectification of these contracts were still lacking, which demonstrated the necessity of the improvement of the legal system relating to the third party logistics services.
