摘要
我国已进入了环境群体性事件的集中爆发期,环境群体性事件需要回归到法制的轨道上来。在风险社会背景下,环境行政机关规制风险活动要符合现代法治意义下的合法性和正当性,这就决定了环评的"双重属性"。我国环评制度具有其功能定位不当、公众参与机制欠缺的现实不足,导致环评结果在很多情况下只具有合法性而不具有合理性,这是导致什邡等环境群体性事件的根本原因。在环境群体性事件的倒逼下,环评制度面临着重构,它应该成为实现风险沟通的平台。
Environmental group events should be brought to the legal orbit. In the risk society, when governing, environmental administrative regulations need to meet the legality and legitimacy accord with modern legal sense, which determines the dual attributes of the EIA. Improper location of the function and shortage of public participa- tion mechanism lead to the exsiting legality, lack of rationality, which is the root cause for Shifang environmental group events. It' s imperative to reconstruct the EIA system, which will be a platform for risk communication in the future.
