摘要
资产证券化作为一种新型的融资在欧美等发达国家的电影产业中发挥着巨大的作用。为推动我国电影产业的发展壮大,在电影产业中引进资产证券化这种新型的融资方式势在必行。但在电影产业引进资产证券化这种新型的融资方式时,考虑到我国电影产业的特殊性,应该在国外原有的基础上进一步创新,那就是建立电影期待版权的资产证券化制度。该制度以法律拟制的资产期待版权作为证券化的标的资产,运作资产证券化的运作模式为计划拍摄的电影融资,可分散电影公司的风险,从而促进电影产业的发展,又可为我国证券市场提供资产支持证券,对我国证券市场的繁荣和多层次证券市场的建成也有助推作用。
The asset securitization, as a new-type financing, playing an important role in the film industry of the Europe and the United States and other developed countries, and it is necessary for our country to introduce the asset securitization to the film industry, which will promote the development of China＇ s film industry. However, this new-type financing is different from what of the Europe and the United States and other developed countries, after all, thinking about the particularity of ours, we must put mind on how to innovate it, establishing asset securitization system of expectant right on film copy- right. The system uses assets of legal fictional film copyright as securitized subject asset, in order to finance for producing a film, which can dispersing risk of film company and to promote the development of the film industry, as well as supporting Chinese stock market and making it boom and diversify it.
