摘要
作为重要的信息传播媒介,图书馆处于著作权利人生产作品和公众利用作品之间,其对作品进行收藏、传播的职能对于双方利益的实现都是不可或缺的。但是,图书馆代表的公益性与权利人代表的私有性却总是矛盾不断,使得图书馆一直陷于著作权侵权的风险之中。三网融合时代的到来,数字资源的大量出现,图书馆业务面临的著作权冲突更加多样化。文章讨论了三网融合环境下图书馆著作权风险的成因和应对策略。
As an important medium of information dissemination, libraries have played a huge role in the guarantee of information access and knowledge dissemination since they came into being. However, the libraries on behalf of public welfare are always in conflict with the right holders on behalf of private ownership. Especially, with the advent of the circumstance of＇Triple Play ,libraries are facing many uncertain factors of intellectual property conflicts. The paper discusses the library intellectual property risk causes and coping strategies under the circumstance of Triple Play.
