摘要
无人驾驶汽车是传统汽车的革新,是人工智能在汽车领域的展现。根据自动驾驶的实现程度,无人驾驶汽车可以划分为五个层级。伴随着无人驾驶汽车时代的到来,交通肇事罪会面临一些挑战与质疑,需要通过法律规制,完善传统的交通肇事罪的犯罪构成要件,并根据不同的无人驾驶发展层级确立交通肇事犯罪的责任承担;完善道路基础设施制度;修改与完善现行道路交通安全法律制度,明确法人可以成为交通肇事犯罪的主体;建立无人驾驶汽车的分级制度以及无人驾驶的记录保存制度等。
Driverless cars are the innovation of traditional cars,which are the demonstration of artificial intelligence in the automotive field.Driverless cars have five levels according to the realization of autonomous driving With the coming of the era of driverless cars,traffic accident crime faces some challenges and questions,but according to the traditional constitutive requirements of traffic accident crime,it will still exist,and need to be legal regulated,However,it is necessary to establish the responsibility of traffic accident crime according to the different development level of unmanned driving.Therefore,China should perfect the legal system of traffic accident crime in the era of unmanned driving,such as improving the system of road infrastructure;Modification and improvement of the current legal system of road traffic safety and clarifies that the legal person can be the main body of traffic accident crime;To establish the classification system of driverless cars and the record keeping system of unmanned vehicles.
