摘要
为了提高中小学教师的执业风险意识,文章从中小学教师执业法律风险的概念、特点和类型入手,分析中小学教师执业法律风险产生的以"外界压力导致的心理疾病——伤害学生而承担法律风险"为模式的社会机理和以"内在素质缺陷——伤害学生而承担法律风险"为模式的个人机理,提出中小学教师增强法律风险意识、强化教育管理责任、把握批评处罚学生尺度、保持与异性学生交往距离和规范学生外出社会程序等防范执业法律风险的具体策略。
In order to improve the risk awareness of primary and secondary school teachers in their teaching,this article discusses the concept, characteristics and types of the legal risks in primary and secondary teachers' teaching. It analyzes the social mechanism and the individual mechanism caused by the legal risks of primary and secondary school teachers. The social mechanism is a kind of mode which is focused on the legal risks that the teachers should bear by hurting students due to the psychological diseases caused by outside presores. The individual mechanism is a king of mode that is focused on the legal responsibilities that the teachers should take by hurting students due to the inherent ability defects. The paper also puts forward specific strategies to prevent the legal risks of primary and second,try school teachers in their teaching, which include enhancing the legal risks awareness, strengthening education and management responsibiity, criticizing and punishing the students appropriately, keeping distance with the students of opposite sex and regulating the system about students going out fot work.
