摘要
土地承包经营权应是一种新型用益物权。目前 ,主要存在土地承包经营权其内容欠缺物权法定、其效力欠缺物权法定、其变动缺乏物权公示法定、其法律规范具有债权法性质等问题。笔者认为 ,其完善农村土地承包经营权物权制度的目标模式 ,应该是依法使土地承包经营权成为一种具有完全物权特质的新型用益物权。对此 ,本文从土地承包经营权的主体、客体、内容、设立、变更、消灭等基本内容方面探讨了农村土地承包经营权物权制度的完善措施。
Land contract & management rights should be a new type of benefited real right. At present, there are the following main problems for land contract & management rights: their content, validity and changes being short of real right legal and their legal standard having the nature of obligatory right. The author argues that the objective pattern of perfect real right system should make the land contract & management rights become a new type of benefited real right which has full real right character according to the law. For this reason, the paper discusses the measures of improving real right system in rural land contract & management rights from the main body, object boby, content, establishment, modification and perishment of land contract & management rights.
