摘要
碳排放权作为现阶段各国应对全球气候变暖的有效措施,正受到广泛关注。各国已将控制和减少碳排放提升到法律层面。以民法为视角,明晰碳排放权内涵、构成要件、性质及变动方式;对其实施民法保护,完善我国民事权利体系,构建我国碳排放权法律制度。
The right of carbon emission as an effective measure to deal with global climate warming has been widely concerned about. Each country has risen the control and reduction of carbon emissions to the law. ？ From the perspective of the civil law, we needto clarify the connotation, components of carbon emis- sion, the elements of nature and the changing ways, and the significance of protecting the right to perfect our system of civil fights, constructing our legal system of carbon emission.
