摘要
中国不动产物权变动模式的研究,过去大多集中在国家制定法的框架内进行,但在单一制政治制度背景下尚待完善的中国制定法,无法忽视长期以来在少数民族地区发挥着促进社会稳定发展重要作用的习惯法,因此,在未来完善不动产物权变动模式相关立法的过程中,应当注意与少数民族习惯法相关内容之间的协调和共存关系。
The studies of the transfer mode of real property have been largely focused within the framework of statutes, but the developing statutes in Chinese law system can not ignore the customary law which has been playing important role in promoting social stability in minority areas since ancient times in the context of a unitary political system, so during the course of the developing process of the statutes on the transfer mode of real property in the future, it should be noted to coordinate the coexisted relationship between the statutes and minority customary law.
