共有物的处分有两种原则,一是"全体同意原则",二是"多数决原则"。前者侧重保护全体共有人的利益,后者侧重保护多数共有人的利益。共有物处分采取"多数决原则"时,少数共有人的利益保护非常重要。未经共有人全体同意或者多数同意的情况下,共有人无权处分共有物的合同应当是有效的,因为无权处分的债权合同不一定能够实际影响其他共有人的利益。共有人无权处分共有物,其他共有人不予承认的情况下,第三人可要求无权处分的共有人行使共有物的分割请求权,单独取得共有物一部分的所有权。另外,第三人还可以向共有人主张违约损害赔偿请求权和定金损害赔偿请求权,或者请求共有人转让其在按份共有中的应有份,第三人与其他共有人继续维持共有关系。
On the disposition of res communes there are two principles: one is unanimity principle, the other majority principle. The former tends to protect the interest of all the co owners while the latter protects that of the majority co owners. When ma jority principle adopted, it is of great importance to protect the interest of minor co owner. If one of the co owners disposes the res communes by a contract without the unanimous or majority consent of the co owners, the contract should be deemed valid, because this kind of credit contract by unauthorized person could not necessarily influence the interests of other co owners. When one of the co owners dispose res communes without authority and the other co owners doesn' t recognize the disposition, the third party can require the unauthorized co owner to claim the partition of the res communes so he can acquire part of the owner ship of the res communes. The third party may otherwise claim damages and the loss of deposit for the breach of contract, or asks the unauthorized co owner transfer his share in the res communes and so the co ownership is maintained by the third party with other co owners.
