摘要
在行政执法和刑事司法相衔接的过程中,证据的可采性是极其重要的一环。新刑诉法第52条对可采的行政执法证据的收集主体、证据形式等内容作了规定,弥补了刑诉法典在这一程序上的空白。同时公安部、最高人民法院、最高人民检察院就该问题在各自的规定和解释里对新刑诉法条文予以了细化,对"行政机关"作了扩大解释,增加了可采的实物证据种类,对言词证据作了例外规定,并受到非法证据排除规则的调整。
In the eoberent proceedings between the administrative law and criminal law, the admissibility of evidence is one of the most important parts. Article 52 of the Amendment of criminal procedure law regulated the evidence collection subjects and evidence forms, which makes up for the procedure blank of criminal procedure code. At the same time, the Ministry of Public Security, the Supreme Court and the Supreme Proeuratorate detailed the Article in their new interpretations so that the refinement of "administrative organ" was expanded and the boundary of admissible physical evidence was enlarged. Also, these evidences should be under the adjustment of the exclusionary rule.
