摘要
当代意义上的法治包含形式意义的法治和实质意义的法治两个方面。我国是一个历史悠久的国家,五千年的历史凝聚了博大精深的文化,对法治现代化建设虽然具有负面的制约因素,但也有积极的作用。构建现代法治文化,应该消除文化中的负面影响,努力发掘积极因素,去其糟粕,取其精华,为法治建设提供文化土壤。
The rule of law of contemporary significance contains the rule of law of form meaning and the rule of law of substantive meaning. China is a country with a long history and the histo- ry of five thousand years coheres the broad and profound culture, which has not only negative restricting factors for construction of legal modernization, but also a positive effect. The con- struction of modern culture of rule of law should eliminate the negative effects of culture, strive to explore the positive factors, get rid of its dross and select the essence, so as to provide cultural soil for the construction of rule of law.
