摘要
改革和完善审判管理制度重要措施之一是加强审判绩效管理。无论是最高人民法院加强审判管理工作的指导性意见,还是各个法院在具体的审判管理实践中,都将审判管理的考核指标分为审判公正、审判效率和审判效果等。但如果将"审判公正"中的程序公正指标与实体公正指标混在一起,就难以有效考评法官和法院,其局限是显而易见的。对于不能量化的审判实体公正指标只能通过"不公正"指标来反映,而且应将"不公正"指标放入审判效果指标,才是解决既存问题的科学路径。
The stress on the management of judge performance is one measure to reform and perfect the system of judge manage-ment. The assessment indicator of judge management is composed of judge justice, judge efficiency and judge effect in the docu-ment from the Supreme People's Court or in the practices of' every local courts. The design for the system briefly satisfies the regu- lar pattern of the judicial operation. However, the mix of the procedural justice indicator and the substantive justice indicator is hard to assess judges and courts, the limits of which are obvious. The substantive justice indicator, which can not be quantized, is reflected only by the injustice indicator and only when the injustice indicator is put into the effect indicator can the existing problems be solved scientifically.
