摘要
我国法官、检察官、律师之间的职业互动主要表现为法官、检察官向律师的流动,这使得我国法律职业之间的互动呈现出流向的逆向性、品质的不良性、机制的非职业性和非制度性。造成我国法律职业互动如此现状和困境的原因主要是法官、检察官待遇上的低薪制、法律职业共同体的缺失和法律职业之间在国家体制上的内外差别。鉴于此,提高我国法官、检察官薪金待遇,增强司法官的工作自主性,积极培育法律职业共同体,消除法律职业之间的体制壁垒,应是促进我国法律职业良性互动的有效途径。
The interaction of Chinese judges, attorneys and lawyers shows the main professional tendency that judges and attorneys become lawyers. This indicates that the interaction within the legal professions is characterized by downward mobility, unhealthy quality, and non-professionalism and non-institution. The current situation or predicament of such an interaction can be mainly attributed to the low salary of judges and attorneys, the absence of legal professional community, and the difference of legal professions between China and other countries in terms of political and state system. Given this, the effective strategies to promote the positive interaction of Chinese legal professionals should include salary increase of judges and attorneys, more work autonomy for judicial officials, development of legal professional community, and removal of systematic barrier for legal professions.
