摘要
研究目的在于探讨我国建设用地使用权新一轮制度创新需要解决的问题和立法方案;研究方法是运用物权法理论,梳理现存的建设用地使用权规范,对未来面临的问题和解决路径作出设计。研究发现,《物权法》并没有与现行法相互衔接,建立统一的、体系化建设用地使用权规范,正在修订的《房地产法》和《土地管理法》也不能完成这样的任务。研究建议修订《暂行条例》并将之上升为法律来实现这一目标,其核心思路是在建立建设用地使用权分类体系基础上,落实和细化《物权法》关于建设用地使用权法律地位、设定、流转、终止等方面的内容。
The purpose of this paper is to explore the legal issues and legislative program of the new round of institution innovation of construction land use right. Through the theory of property law, it sorts out current regulations concerning construction land use right and designs the resolution routes of future problems. It arrives at the conclusions that the Real Right Law of the PRC, does not link up with current law, and current amendment of the Land Administration Law or the Urban Real Estate Administration Law cannot provide unified and systematic regulation concerning construction land use right. It makes suggestions on amen- ding the Interim Regulations on the Assignment and Transfer of the Right to the Use of the State-owned Land in the Urban Areas and upgrading it to law in order to establish unified and systematic regulation on construction land use right, whose core idea depends on the implementation and refinement of the Real Right Law concerning the legal content, enactment, transfer and termination of construction land use right based on the establishment of classifi- cation system concerning construction land use right.
