摘要
我国劳动教养制度经历了56年的历程,每一个发展历程都反映了那个时代的特色。进入21世纪之后,劳教制度在现行法律体系中的地位愈加尴尬。于是,劳教制度的废与存问题摆在了我国立法机关和学术界、实务界面前。终于,全国人大宣布,用《违法行为教育矫治法》取代劳教制度。然而,立法仍然需要对一些具体问题进行深入探讨。
The system of reeducation through labor in China has experienced 56 years of his-tory, each development reflect the characteristics of The Times. In the 21 st century later, the de-tention system in the current legal system in the position more embarrassed. Then, the detention system of waste and made problems in China in the legislature and academia, practice before world. Finally, the National People＇s Congress announced that, with the illegal behavior educa-tion correctional method ＂to replace the detention system＂. Legislation still need to some specific issues to discuss.
