摘要
《瑞士债法典》简洁性的特点体现在用语通俗但不排斥专业性和技术性;条文数量少但内容容量大,在一定程度上扩大了法律的适用范围,使法律具有灵活性和全面性。中国民法典的编纂应当在形式上借鉴《瑞士债法典》,在保证专业化的前提下使语言通俗、简单。表达方面应当采取区分原则、合并同义词句等立法技术精简条文数量,同时要确保法律用语的明确性和精确性。
The characteristic of the Code of Obligation of Switzerland is simplicity, which is reflected in its popular words and professional and technical terminology and in the small number of concise provisions which expand the scope of application of the law to some extent and also make the law flexible and comprehensive. The Civil Code of China should some enlightenment from the Code of Obligation of Switzerland in the form, which makes its words popular and simple under the premise of ensuring specialty, which applies various legislative technologies such as the principle of distinction and merging synonyms to reduce the number of articles, and which makes the legal terminology clear and accurate.
