摘要
指出近年我国专利申请量居高不下,但专利申请繁荣的背后也暗藏着一系列危机,问题专利是其中之一。所谓问题专利是指不当授权的专利。以1985年以来被宣告无效或部分无效的专利为问题专利的研究样本,分析其专利类型、发展态势、地区分布、技术偏好、生命强度,从而对我国问题专利的现状及特征有一个整体的了解,并在此基础上从专利审查制度、专利资助政策和专利无效程序的角度探讨我国问题专利的形成原因,为最终应对问题专利打好基础。
The patent applications remain high in recent years , but there are a serious of crises including questionable patent. The questionable patents are improper authorized ones. Taking the patents that have been declared invalid or partially invalid since 1985 as samples, this paper discusses their types, development trend, geographical distribution, technology preferences and intensity of life, and has an overall understanding of the status and features of domestic questionable patents. Then it probes into the causes from the perspective of the patent examination system, patent subsidy policy and patent invalid program, and lays a foundation for dealing with questionable patents.
