摘要
在现有的法律界定成果基础上,从国内法操作层面探讨了界定传统知识应受保护对象的可行性,认为不断变化的传统知识具体形态是可以通过考察多份实践行为样本来确认的,以文化特征性为标准用以判定应受保护对象是可以实现的。
On the basis of previous achievements in legal definition,this paper discusses the feasibility of determining what tradition knowledge should be protected from the practice of domestic laws.It is believed that the concrete forms of the constantly changing traditional knowledge can be identified through the investigation of a number of practices.However,it is feasible to determine tradition knowledge objects for protection by evaluating their cultural traits.
