摘要 研究目的:研究城乡建设用地增减挂钩中的集体土地处置方式,提出集体土地权益保护的措施。研究方法:文献研究和政策分析法。研究结果:当前中国集体土地产权制度的缺陷和地方政府过度依赖土地财政等,导致增减挂钩试点中集体土地权益价值未得到全面体现。研究结论:建议通过立法明确集体土地权利地位、全面实施集体土地确权登记、规范集体土地流转管理、建立农村地价管理体系等措施完善增减挂钩政策。 The purpose of the paper is to propose measures for protecting rural collectively-owned land rights and interests through analyzing the proper way of land trade in the LUTRG project. Methods included literature review and policy analysis. The result showed that the rural land benefit could not be fully recognized due to the flaws of current property right system of rural land and the local governments' dependence on land transfer revenue for the purpose of enlarging local budget. The paper concluded with proposition aiming to ameliorate the LUTRG policy, such as 1 ) to clarify the legal status of collective land property; 2) to completely register the collective land; 3) to regulate the collective land transfer; and 4) to speed up the establishment of rural land price system.
