摘要
土地征收,是指国家根据公共利益的需要,以补偿为条件而强制取得他人所有的土地制度。我国不存在私人土地所有权,土地征收唯一的对象是集体所有的土地。当前,随着我国工业化和城镇化进程的加快,土地征收规模不断扩大,存在的问题集中表现在侵害集体土地所有权和农民的土地承包经营权上。解决问题的方案有:通过立法明确集体土地所有权代表、将土地承包经营权纳入征收客体和补偿范围,以公益诉讼保护集体土地合法权益等。
Land expropriation means the land system that according to the need of public interests, the country compulsorily obtains other＇ s land on the condition of compensation.In China, there is no private land ownership, the only object of expropriation is collective land. At present, with the increasing industrialization and urbanization in China, and tile constant expansion of land expropriation, the problems are focused On trespassing on collective land ownership and the farmer＇ s land contract management right. The solutions： By legislation, on behalf of collective land property, the land contract management right are brought into the object of expropriation and the scale of compensation, so the legal rights and interests of collective land can be protected by using the suit of public interests.
