摘要
当代中国正处于社会变迁关键时期,应正确理解此一时期刑法发展的特点与走向。整体而言,刑法发展呈现出保障功能强化、罪刑规范更趋完备、刑罚适用趋向轻缓以及刑法国际化有所增强的特点;在发展走向上,主要表现为和谐社会下的刑事政策调整、法治社会下的刑法立场调整以及风险社会下的犯罪形态调整三个方面。基于上述因素,我国的立法和司法实践均发生了重要转变,能够更好地发挥刑法的基本机能。
Now China is in a critical period of social change.It is important for us to understand properly the characteristics and trend of the criminal law development in this period.Overall,the development of the criminal law has demonstrated the enhanced function for security,the improved specifications for crime,the trend of gentle penalty and the enhanced international criminal law.In the orientation of development,it has shown itself mainly in three aspects： the adjustment of criminal policy to meet the needs in the harmonious society,the adjustment of criminal law position under the rule of law,and the adjustment of patterns of crime in the risk society.Based on the above factors,the legislative and judicial practice in China has undergone important changes,being able to play a better role for the basic function of criminal law.
