摘要
目的:促进我国药害救济、赔偿的联动机制构建,保障药害受害者的权益。方法:介绍药害的种类,分析药害救济、赔偿的必要性以及目前我国实行的药害救济、赔偿存在的问题。结果与结论:目前我国存在按现有法律法规药害责任明确但赔偿艰难、尚未建立药品不良反应救济制度、药害举证困难等问题。建议在卫生部成立药害救济、赔偿事务机构,负责药害受理、药害鉴定、基金给付、药害诉讼、部门协调等工作,构建我国药害救济、赔偿的联动机制。
OBJECTIVE： To establish relief-compensation linkage mechanism of drug misadventures in China to protect the rights of victims. METHODS： The types of drug misadventures were introduced, and the necessity and difficulty of relief and compensation to drug misadventures were analyzed. RESULTS ＆ CONCLUSIONS： At the present, the responsibility to drug misadventures is clear under current law and regularity but it is difficult to achieve compensation. ADR relief system hasn＇ t been established in China and enough evidence can＇ t be obtained to certify drug misadventures. The relief-compensation organization of drug misad- ventures should be established in Department of Health, which is in charge of receiving filing, identification, fund management and payment, litigation and organization coordination of drug misadventures to buiJd relief-compensation linkage mechanism of drug misadventures in China.
