摘要
《体育法》通过设置"授权立法"条款,将制定某些体育法规范性文件的权力授予其他主体,由其他主体来行使立法权力。《体育法》授权立法条款主要表现为两种类型:明示授权立法条款与默示授权立法条款,各有不同的意义,但在设置这些授权立法条款时存在一些立法技术的缺陷与不足,《体育法》修改的重要内容之一就是设置完善的授权立法条款。
Sports Law delegates the legislative power to the other governmental organizations by setting the authorized sports legislation clauses.There are two types of the clauses,the express authority clause and the implied authority clause,each of which has different meanings.While theses clauses still have weaknesses,to include complete authorized legislation clauses is important in amendment of the Sports Law.
